                   AN ORDINANCE CLOSING AND ABANDONING A PORTION
                   OF AN ALLEY LOCATED NORTHWEST OF FAGAN STREET,
                   NORTHEAST OF HAMILL ROAD, MORE PARTICULARLY
                   DESCRIBED HEREIN, UPON CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned a portion of an alley located northwest of Fagan
         Street, northeast of Hamill Road, more particularly described
         herein, and as shown on plat attached hereto and made a part
         hereof by reference:
                Part of a 20 foot wide unopened alleyway.  To find
                the true point of beginning of said part of
                alleyway, start on the northwest line of Fagan
                Street 140 feet northeast of the intersection of
                the northwest line of Fagan Street with the
                northeast line of Hamill Road, said point being the
                northeast corner of lot 257, block 14, Oakview New
                Era Land Company's Addition No. 1, as shown by plat
                of record in plat book 5, page 69, R.O.H.C., thence
                northwest 30 feet with the northeast line of said
                lot 257 to the northeast corner of lot 258, said
                Oakview Addition, the true point of beginning,
                thence continuing northwest 40 feet with the
                northeast line of said lot 258 to the northwest
                corner thereof, thence at a right angle northeast
                20 feet to a point in the southwest line of lot 64,
                block 14, said Oakview Addition, thence southeast
                40 feet with the southwest line of said lot 64,
                thence at a right angle southwest 20 feet to the
                northeast corner of lot 258, the true point of
                beginning.  Tax Map No. 167F-D-6 and 8.
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:
                1. The City of Chattanooga has a sewer located
                   within said right-of-way and reserves an
                   easement the width of the right-of-way for the
                   purpose of maintaining said sewer.
               
                3. The areas reserved for utility easements must be
                   kept free and clear of all structures.
               
                4. All existing easements are retained.
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
